We are an Aussie-founded coffee brand built on a simple idea: do things properly, treat people well, and never let standards slip. Born in Avalon on Sydney’s Northern Beaches and brewed fresh in Los Angeles, Ministry of Coffee has grown from a local café into a broader hospitality, retail and online brand built around great coffee, genuine service and strong community connection.
These Terms of Use govern your access to and use of the Ministry of Coffee website, any related pages, our online ordering channels, retail store, subscriptions, forms, content, communications and any other online services we make available through the site.
This site and the related Ministry of Coffee online services are operated by Ministry of Coffee LLC, trading as Ministry of Coffee. In these Terms, “Ministry,” “we,” “us,” and “our” mean Ministry of Coffee LLC and the website, online shop, café ordering channels and related services it operates under the Ministry of Coffee brand.
By accessing or using the site, placing an order, creating an account, submitting a form, purchasing a product, subscribing to a recurring order, or otherwise using our online services, you agree to these Terms. If you do not agree, do not use the site.
1. Eligibility and use
You may use the site only if you are legally capable of entering into a binding agreement.
The site is not directed to children under 13. If you are under the age of majority where you live, you should use the site only with a parent or guardian involved.
You agree to use the site lawfully and in a way that does not interfere with the site, its security, or anyone else’s use of it.
2. Accounts
Some features may allow or require you to create an account, including subscriptions, saved details, order history and similar customer functions.
If you create an account, you agree to provide accurate and current information, keep it up to date, keep your login details secure, and let us know promptly if you think your account has been compromised.
You are responsible for activity on your account unless it results from our own misconduct or failure.
We may suspend or close accounts where reasonably necessary, including where information is inaccurate, conduct is unlawful or abusive, fraud is suspected, or these Terms have been breached.
3. Orders, purchases and requests
The site may allow you to place café orders, buy retail products, purchase gift cards, sign up for subscriptions, or submit requests for catering, wholesale coffee, private events, collaborations or InKind support.
All orders and purchases are subject to availability, acceptance and any verification we reasonably require.
Submitting an order does not mean it has been accepted. We may decline, cancel or limit an order where reasonably necessary, including where products are unavailable, there is an obvious pricing or product error, payment cannot be processed, fraud or misuse is suspected, fulfilment is not possible, or the request is outside our service capability.
If we cancel an order after payment has been taken, we will refund the relevant amount in accordance with applicable law.
4. Toast ordering
We use Toast to support café point-of-sale functions and certain location-based online ordering experiences.
If you place an order through a Toast-powered ordering flow, relevant parts of that transaction may be processed through Toast and related service providers for payment, fulfilment, pickup, delivery coordination, communications and support.
By placing an order through a Toast-supported experience, you acknowledge that additional third-party terms or privacy policies may apply to those services.
5. Shopify store
We use Shopify to power the online retail store and certain eCommerce functions, including browsing, cart, checkout and order management.
If you purchase retail products through our online store, relevant parts of that transaction may be processed through Shopify and related service providers for checkout, payment, fraud review, fulfilment and store operations.
By purchasing through the Shopify-powered store, you acknowledge that additional third-party terms or privacy policies may apply to those services.
7. Pricing and payment
Prices shown on the site are in USD unless otherwise stated.
Prices may differ across in-store purchases, Toast-powered café ordering, Shopify retail purchases and promotional campaigns. Taxes, fees, delivery charges and similar amounts may apply depending on the order type and location and will be shown where applicable before checkout.
You agree to provide valid and current payment information.
If a product or order is listed with an obvious pricing or content error caused by a typo, system issue, supplier issue or platform error, we may correct the error and, where reasonably necessary, cancel or refuse the order. If payment has already been processed, we will refund the amount paid.
8. Subscriptions
If recurring coffee subscriptions are offered through the site, they are subject to these Terms and any subscription-specific terms shown at sign-up.
By purchasing a subscription, you authorise us or our service providers to charge your payment method on a recurring basis according to the frequency you choose, until you pause, skip or cancel in line with the applicable settings and terms.
You are responsible for keeping your payment details current.
We may change, pause or discontinue subscription products, pricing, schedules or features where reasonably necessary. If a material change affects an active subscription, we will provide notice where required by law.
9. Gift Cards
If gift cards are offered through the site, they may also be subject to additional terms shown at purchase.
Gift cards are generally non-refundable except where required by law. They cannot be redeemed for cash except where required by law. We are not responsible for lost, stolen or unauthorised use of gift cards except where required by law.
10. Catering, wholesale and other enquiries
Forms and enquiries submitted through the site for catering, wholesale, private events, collaborations, InKind or similar matters do not create a binding agreement on their own.
Any quote, booking, service arrangement or supply commitment is subject to separate confirmation by Ministry and may also be subject to additional terms, deposits, cancellation conditions or written approvals.
11. Promotions
We may run offers, discount codes or limited campaigns from time to time.
Unless we say otherwise, promotions cannot be combined, apply only for the stated period, may be limited by location, stock or channel, and may be changed or withdrawn where reasonably necessary.
We may refuse to honour a promotion where we reasonably believe there has been misuse, abuse or a breach of these Terms.
12. User conduct
You must not use the site in a way that is unlawful, misleading, fraudulent or abusive, infringes anyone’s rights, interferes with the operation or security of the site, introduces harmful code, attempts unauthorised access, scrapes site content for commercial use without permission, uses bots or scripts without authorisation, impersonates others, or submits content that is defamatory, obscene, threatening or otherwise inappropriate.
We may suspend or block access where we reasonably believe these Terms have been breached.
13. Intellectual property
All content on the site, including the Ministry name, logo, branding, trade dress, designs, artwork, menus, product names, copy, photography, graphics, video, layout and related materials, is owned by or licensed to Ministry and protected by intellectual property laws.
You may use the site for personal, non-commercial use only.
You must not reproduce, republish, distribute, modify, transmit, scrape, frame, mirror, sell, licence or otherwise exploit any part of the site or its content without our prior written consent.
“Ministry of Coffee” is a trademark pending brand of Ministry of Coffee LLC.
14. Reviews and user content
If you submit reviews, comments, messages, photos or other content to us, you confirm that you have the right to submit it, that it is accurate to the best of your knowledge, that it does not infringe anyone else’s rights, and that it is not unlawful, misleading, defamatory, abusive or obscene.
You grant Ministry a non-exclusive, worldwide, royalty-free, transferable licence to use, reproduce, adapt, publish, display and distribute that content in connection with the business, brand, site and related marketing, subject to applicable law and our Privacy Policy.
We may remove or refuse to publish content at our discretion.
15. Third-party services and links
The site may contain links to third-party websites, platforms, ordering systems, payment tools, social media services or other external content.
We do not control those third-party services and are not responsible for their content, availability, terms or privacy practices. Your use of them is at your own risk.
16. Disclaimer
The site and all content, products and services made available through it are provided on an “as is” and “as available” basis to the fullest extent permitted by law.
We aim to keep the site smooth, accurate and reliable, but we do not guarantee uninterrupted access, error-free operation, absolute security, or that all content will always be complete and current.
Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.
17. Limitation of liability
To the fullest extent permitted by law, Ministry will not be liable for indirect, incidental, consequential, special or exemplary damages arising out of or related to your use of, or inability to use, the site, including loss of profits, loss of data, loss of goodwill or business interruption.
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to the site, any order, or these Terms will be limited to the amount you paid us for the relevant product or service, or USD $100, whichever is greater.
Nothing here limits liability that cannot lawfully be limited or excluded.
18. Suspension and termination
We may suspend, restrict or terminate access to all or part of the site where reasonably necessary, including where you breach these Terms, fraud or abuse is suspected, legal or security reasons require it, or a third-party platform is unavailable or discontinued.
Termination does not affect rights or obligations that arose beforehand.
19. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles, unless another law must apply.
If you have an issue with Ministry, contact us first and we will try to sort it out quickly and in good faith.
Any dispute arising out of or relating to these Terms, the site, or a purchase made through the site will be resolved in the state or federal courts located in Los Angeles County, California, unless applicable law requires otherwise.
Nothing in this section prevents either party from seeking urgent equitable or injunctive relief where appropriate.
20. Changes to these Terms
We may update these Terms from time to time to reflect changes in our business, technology, suppliers, site features or legal obligations.
When we do, we will post the updated version on this page and revise the last updated date above. Continued use of the site after changes take effect means you accept the updated Terms.
